What subcontract overhead rates will Georgia Tech use for an SBIR/STTR subcontract from your company?

Overhead rates are determined by the Federal agency funding the prime award.  Department of Defense Agencies (Navy, AFOSR, Air Force, Army, MDA, DARPA) use the “research uncapped rate” .  Non Department of Defense Agencies use the “research capped” rate.  Current rates can be found here.

Who should I contact to get an STTR/SBIR subcontract in place?

Can we include all FAR/DFARs in the Prime Contract?

Not necessarily.  We will make an effort to include all “required flow-downs.”  However, in certain situations, US Export Control laws, Georgia State Law, or Institute policy may result in inability to participate in the subcontract or accept certain.  Certain FAR clauses, such as “default” clauses, are not accepted in any situation.

Can we own the intellectual property generated since the purpose of the STTR/SBIR program is to promote small business technology commercialization?

No.  While it is true that the purpose of the SBIR/STTR program is to promote small business research and development with a goal of technology commercialization, inventions and other creative works developed at Georgia Tech under an SBIR/STTR subcontract are owned by Georgia Tech Research Corporation.  This policy is based on the mission of the Institute and the directives of the Bayh-Dole Act.  US Government “march-in” right will, of course, be respected.
