What overhead rates should I use in the budget for an SBIR/STTR subcontract from a company?

Overhead rates are determined by the Federal agency funding the prime award.  Department of Defense Agencies (Navy, AFOSR, Air Force, Army, MDA, DARPA) use the “research uncapped rate.”  Non Department of Defense Agencies use the “research capped” rate.   These rates can be found here .

What internal OSP processes do I follow if I have been contacted by a small company to perform work under an SBIR/STTR?

You should proceed as you would under a government subcontract: provide a complete routing form, budget and statement of work to OSP.  SBIR/STTRs are currently handled in the Industry Contracts Office.

Can I start my own company to apply for STTR/SBIR funding and subcontract to my lab at Georgia Tech?

No, if you have a significant equity stake in the company you cannot subcontract to your own lab.  Such a relationship would violate Georgia law (O.C.G.A. 45-10-23) if you or your family owns more than 25% of the company.  Ownership of greater than 10% of equity in any company that sponsors research in any capacity at Georgia Tech must be managed according to NSF conflict of interest guidelines and Georgia Tech conflict of interest policies.

Can a Phase II SBIR/STTR subcontract be processed at Georgia Tech as a “continuation” or “modification” of an existing project?

No, the Phase II should be set up as an independent project so costs and performance periods are segregated according to Phase and prime contract numbers.  However, the Phase II contracting process is often more simple than the Phase I process since a precedent for the research contract exists.

Can I be the PI for a small business in an SBIR STTR?

SBIR program rules require that the PI on the prime contract be employed more than 50% of the time at the company receiving the SBIR award.  Thus, a full-time faculty member at Georgia Tech could not serve as a PI on the SBIR prime while employed at the Institute full-time. A faculty member can only be a PI on an STTR if done in accordance with Georgia Tech consulting limitations and effort is reported accurately.
